These are the terms and conditions under which you purchase and book your harbor cruise.  You and your guests are bound by these Terms & Conditions, so it is important you read them carefully.  It is suggested that you have all of your guests visit this website and review these Terms & Conditions.

When you purchase and book a harbor cruise, you agree that you have the authority from all your guests to accept these Terms & Conditions on their behalf.  Parents / Legal Guardians accept these Terms & Conditions on behalf of their children.

DreamBuilder currently only operates within the harbor in Marina del Rey, California.

There are future plans to operate in other harbors so inquiries about other cruise locations are welcome.  Although the boat is certainly seaworthy, we only operate the boat within protected harbors to ensure passenger safety and comfort.  This means that we do not, under any conditions, offer cruises onto the open ocean.  Furthermore, we abide by all federal, state, and local boating laws and regulations.

Once you purchase and book your harbor cruise, please check your reservation to ensure the details are correct.

Reservations will be held until 1 hour prior to departure.  No refunds will be made in the event of "no call / no shows", unused, or expired promotions.  We understand that on occasion situations may arise that may require you to reschedule your cruise.  When that happens, you should notify us as soon as possible.

Parents / Legal Guardians are responsible for their children and teenagers at all times.  If a child or teenager displays dangerous or disruptive behaviour, the ‘Rights of the Captain’ will be applied to both parent/legal guardian and child/teenager.  Passengers age 13 and under must wear a life vest at all times during the cruise.

In the event that you decide to end the cruise prior to its scheduled end time, you are not entitled to a refund or credit for the unused portion of the cruise.

We strictly adhere to all federal, state, and local laws and regulations, including those pertaining to the consumption of alcohol.  Any guests who desires to consume alcohol and/or wine during a cruise must be age 21 or older with no exceptions.

We reserve the right to ask for state or federal identification.  Furthermore, we reserve the right to limit the amount of alcohol consumed on our cruises.

Alcohol should be used and consumed in a responsible manner.  Guests should be aware that the consumption of alcoholic beverages can impair them and long-term use can adversely affect their health. Women should not drink alcoholic beverages during pregnancy because of the risk of birth defects.

Except for significant personal injury caused by Reckless Conduct by us or our agents, we exclude liability for all Excluded Recreational Liabilities arising out of the supply of Recreational Services.

Where consumer laws and other laws permit us to exclude our liability, we will not be liable for:
     • loss of, or damage to, any personal items or other belongings
     • sickness, injury or death, unless caused by our proven negligence or failure to provide services with due care and skill and that are reasonably fit for purpose.

In addition, our liability will be reduced in proportion to any negligence or fault on your part.

In the unlikely event you have reason to take legal action, you agree to use all reasonable efforts to bring the issue to our attention as soon as possible.

We strictly adhere to Privacy Laws to protect your personal information.

During the booking process, we will ask for your personal information.  We will use this information solely for the purpose of reserving, scheduling, booking, and operating the cruise.  You information will not be shared with or sold to third parties.

To ensure a safe and enjoyable cruise for all our guests, we prohibit bringing certain items onboard.  We can deny boarding or disembark any person in possession of any weapons, illicit substances, explosives, incendiary devices, or other dangerous items that are strictly prohibited.  Each Guest warrants that no such prohibited articles are contained in any receptacle or container carried onboard the boat.  Each guest will be individually responsible for any and all damage and/or loss caused by violation of this policy, and no refund or credit will be issued.

Once the cruise has commenced, if a guest seriously affects the safety, well-being or enjoyment of themselves or any other person onboard, the Captain has the right to disembark the guest from the boat.  In such cases, we are not responsible for any expenses including the return to your car or home.  In addition, you will not be entitled to any refunds.  While the Captain will always act reasonably in these circumstances, you accept that the safety, well-being and enjoyment of everyone onboard, comes first.

Smoking and/or Drug Usage is prohibited throughout the duration of the cruise.  You agree to strictly comply with our non-smoking / no drug use policy.  Any violation of this policy shall constitute a material breach of this cruise contract.  In the event of such breach, Guest forfeits all rights, including the right to remain on board.  We shall not be liable for any refund or credit whatsoever to any Guest disembarked pursuant to this provision, or who disembarks because another Guest is so disembarked.

You are responsible for ensuring that no travel restrictions apply to you and your guests.  If police or any other authority in any jurisdiction notify us of, or we otherwise become aware of, any matter that reasonably causes us to believe your presence onboard presents a risk to your own health or safety or the health or safety of other guests and crew, we may deny you boarding.  A full refund will provided to any guest denied boarding on this basis.

Safety is always our top priority.  Inclement weather can cause hazardous conditions that may result in delaying or canceling your cruise.

While we will advise you of weather conditions, the decision to delay or cancel a cruise is ultimately ours.  Even if you decide that you want to proceed with a cruise despite weather conditions, we reserve the right to decide to delay or cancel the cruise.

In the event that your schedule does not accomodate a delay or cancellation, we will make our best effort to reschedule your cruise at that time.  The issuance of a rain check or a refund is strictly done at our discretion.

We care about the health and safety of our guests.  If you or anyone from your party has a physical disability or medical condition which may require special assistance, please advise us at the time of booking; failure to do so may release us from any liability for loss, damages or other compensation arising from or related in any way to such disability or condition.  To better assist you, if you have a medical condition that requires medical attention, medication, or special treatment, we may ask you to complete a health questionnaire.

When booking a cruise, you warrant that you and your guests are physically fit to cruise at the time of embarkation.  If a guest has a condition that we decide may seriously affect the enjoyment, health or safety of themselves or any other person on board, we can refuse or cancel a booking, where necessary. We will give reasonable consideration when reaching this decision and will advise you as soon as possible.  As long as you have provided us with a completed health questionnaire with all relevant information about the condition, you will be entitled to a full refund if we cancel your booking on the basis of this condition.

Guests that need assistance should always be accompanied by a caretaker as our crew are unable to act as personal caretakers.  We reserves the right to require that any Guest, who is not self-sufficient, travel with a companion who shall take responsibility for any assistance needed during the cruise and in case of emergency.

In addition to the limitations on medical care described above, prenatal and early infant care, in particular, may require specialised diagnostic facilities and/or treatment that are not obtainable during the cruise.  Guests who are pregnant during their cruise should verify that the mother and baby are in good health, fit to cruise, and that the pregnancy is not high-risk.

We are not a healthcare provider and may not be held liable for the sickness, injury, or death of any guest arising from any advice, treatment, care, services provided by anyone during the cruise.
